Tragedy of 1965/1966 has lasted for 56 years. The Investigation Team of National Commission of Human Rights pro-justicia has found evidence and facts that there is a chain of command involvement of the state apparatus in orchestrating the 1965-1966 mass killings. Confirmed by the decision of the International People’s Tribunal of The Hague that the 1965 crimes against humanity were also genocide, killing of a race and the destruction of a group of people. Therefore, the state is obliged to investigate thoroughly by judging the perpetrators to the ad hoc Human Rights Court.

It has been 12 years since the Human Rights Commission announced, however the Attorney General has not carried out to develop the Human Rights Court and additionally no signals to fulfil the comprehensive solution for upholding human rights and justice for the victims.

Now, the Victims and Witnesses are elderly, living in conditions of illness, and poverty due to social, political and economic discrimination and persecution and terror as well. In fact, now one by one has died because of old ages.

It’s not a matter of being brave or not, this is a constitutional mandate: The state is obliged to protect its citizens from human rights violations (Article 28 of the 1945 Constitution, Law No. 39/Year 1999 and Law No. 26/2000).

Will this country continue to perpetuate impunity? While the Victims and Witnesses are still alive, it is time to uphold truth, justice and humanity.

Tragedy 1965/1966 telah berlangsung selama 56 tahun. Tim Penyelidik pro justicia Komnas HAM telah menemukan bukti dan fakta ada rantai komando keterlibatan aparat kekuasaan dalam ikut merekayasa pembunuhan massal 1965-1966. Dikuatkan oleh keputusan Pengadilan Rakyat Internasional Den Haag bahkan kejahatan kemanusiaan 1965 adalah juga genosida, pembunuhan suatu ras dan penghancuran suatu kelompok masyarakat. Karena itu negara wajib mengusut tuntas dengan mengadili para perpetrators dalam Pengadilan HAM ad hoc.

Namun, sudah 12 tahun sejak keputusan Komnas HAM diumumkan, Jaksa Agung belum juga mengadili para penjahat dan tidak ada tanda-tanda untuk penyelesaian menyeluruh pelanggaran hak asasi manusia yang berat tersebut.

Kini, para Korban dan Saksi telah berusia lanjut, hidup dalam kondisi sakit, dan kemiskinan akibat diskriminasi sosial, politik dan ekonomi serta persekusi dan terror. Bahkan, satu per satu telah meninggal dunia dimakan usia.

Bukan masalah berani atau tidak, ini adalah amanat konstitusi: Negara wajib melindungi warganegaranya dari tindak kejahatan pelanggaran hak asasi manusia (Pasal 28 UUD 1945, UU No.39/Tahun 1999 dan UU No. 26/Tahun 2000).

Akankah negeri ini terus-menerus melanggengkan impunitas? Selagi Korban dan Saksi masih hidup saat yang tepat untuk menegakkan kebenaran, keadilan dan kemanusiaan.

Nyalakan terus Semangat Gwangju 5.18 untuk menegakkan hak asasi manusia dan demokrasi.
