Surat YPKP 65 Kepada Komisioner Tinggi HAM-PBB Zeid Ra’ad al Hussein

Dear Sir,

It is my proud for the honorable opportunity to have a meeting with you.

On behalf of the Victims and families of the Tragedy of the 1965-66 Violations of Human Rights, Massacre in Indonesia (Tragedy), I would like to report that:

Approximately 500.000 – 3.000.000 people were killed, force disappearances, kidnap, 200.000 – 500.000 people were detained and got force-labor, 500 – 1.000 of girls and women were raped as the impact of the Tragedy which happened in 1965 and the years after- the numbers may increase as the investigation is still going on. According to the Recommendation of the Republic of Indonesia on Human Rights Team of  Investigation pro-judicial (2012) and was confirmed by the Final Decision of the International People’s Tribunal of the Tragedy  which was arranged in Den Haag (2016).

In Addition the Report of the Investigation of Mass Graves by YPKP 65 (Indonesian Study for the Massacre of the Tragedy 1965-1966) in 2018, there are 162 Mass Graves sites throughout Indonesia – the number may increase as the investigation has not finished yet.

YPKP 65 also collected and documented Letter of Release that were prepared and designed  by military/the State that the formerly political detainees are not guilty, no any involvement of the what so called the coup of 1965.

Thousands testimony of the Victims who are now still alive are safely filed by YPKP 65 make confirmation that the Victims of the Tragedy should be rehabilitated.

It is obviously known that the tragedy was designed perfectly, systematically and  massively by military and the state.

Until this time the Government of Republic of Indonesia has never shown its willingness to solve the case, even it has been happening for nearly 53 years.

Due to those reasons I herewith urge to you to take further action so that the Indonesian Government should stop impunity, discrimination, stigmatization and persecution to the Victims of the Tragedy of 1965-66 and to let truth, justice, democracy, humanity erect in Indonesia by arranging judicial or non-judicial process.

In order not to repeat the same crimes against humanity  in the future, the perpetrators should be punished by the law.

Finally, I urge if the RI’s Government still does not take any  action to fulfill the case, I hope the UN High Commissioner to take over the case of the Tragedy 1965  to carry out under International convention, jurisdiction and laws. It is clearly stated that if any Government (Indonesia) does not have any willingness, any capabilities, seriousness to handle the case of violations of Human Rights, then the International Institution such as United Nations of Human Rights should take over.

United Nation should make an independent investigation, to the Victims, Witnesses and the Perpetrators, make a forensic investigation, exhumation and  memorialization. United Nations of Human Rights Office of High Commissioner should put the Tragedy of 1965-66  Crimes against Humanity and Genocide in Indonesia as the greatest  humanitarian crisis in this  millennium.

Yang terhormat,

Saya bangga dengan kesempatan terhormat untuk mengadakan pertemuan dengan Anda.

Atas nama Korban dan keluarga Tragedi Pelanggaran HAM 1965-66, Pembantaian di Indonesia (Tragedi), saya ingin melaporkan bahwa:

Sekitar 500.000 – 3.000.000 orang terbunuh, penghilangan paksa, menculik, 200.000 – 500.000 orang ditahan dan mendapat kerja paksa, 500 – 1.000 anak perempuan dan perempuan diperkosa sebagai dampak tragedi yang terjadi pada tahun 1965 (dan tahun-tahun berikutnya) jumlahnya bisa meningkat karena penyelidikan masih berlangsung. Menurut Rekomendasi Republik Indonesia untuk Tim Investigasi Hak Asasi Manusia pro-yudisial (2012) dan dikonfirmasi oleh Putusan Akhir Pengadilan Rakyat Internasional Tragedi yang diselenggarakan di Den Haag (2016).

Sebagai tambahan dalam Laporan Investigasi Kuburan Massal oleh YPKP 65 (Studi tentang Pembantaian di Indonesia 1965-1966) pada tahun 2018, ada 162 situs Mass-Graves di seluruh Indonesia – jumlahnya dapat meningkat karena penyelidikan belum selesai.

YPKP 65 juga mengumpulkan dan mendokumentasikan Letter of Release yang disiapkan dan dirancang oleh militer / bagian negara bahwa tahanan politik sebelumnya tidak bersalah, tidak ada keterlibatan dari apa yang disebut kudeta tahun 1965.

Ribuan kesaksian korban yang sekarang masih hidup aman diajukan oleh YPKP 65 membuat konfirmasi bahwa Korban Tragedi harus direhabilitasi.

Jelas diketahui bahwa tragedi itu dirancang secara sempurna, sistematis dan besar oleh militer dan negara.

Sampai saat ini Pemerintah Republik Indonesia tidak pernah menunjukkan kesediaannya untuk menyelesaikan kasus tersebut, bahkan sudah terjadi selama hampir 53 tahun.

Karena alasan tersebut, saya mendesak anda untuk mengambil tindakan lebih lanjut sehingga Pemerintah Indonesia harus menghentikan impunitas, diskriminasi, stigmatisasi dan penganiayaan kepada Korban Tragedi 1965-66 dan membiarkan kebenaran, keadilan, demokrasi, kemanusiaan; terwujud di Indonesia. dengan mengatur proses peradilan atau non-peradilan.

Agar tidak mengulangi kejahatan yang sama terhadap kemanusiaan di masa depan, pelaku harus dihukum oleh hukum.

Akhirnya, saya mendesak jika Pemerintah RI masih tidak mengambil tindakan untuk memenuhi kasus ini, saya harap Komisaris Tinggi PBB untuk mengambil alih kasus Tragedi 1965 untuk melaksanakan konvensi internasional, yurisdiksi dan undang-undang. Dengan jelas dinyatakan bahwa jika Pemerintah (Indonesia) tidak memiliki kesediaan, kemampuan, keseriusan menangani kasus pelanggaran HAM, maka Institusi Internasional seperti Perserikatan Bangsa-Bangsa untuk Hak Asasi Manusia harus mengambil alih.

Perserikatan Bangsa-Bangsa harus melakukan penyelidikan independen, kepada Korban, Saksi dan Pelaku, melakukan penyelidikan forensik, penggalian dan pengingatan. Kantor Komisaris Tinggi Hak Asasi Manusia Perserikatan Bangsa-Bangsa harus menempatkan Tragedi 1965-66 Kejahatan terhadap Kemanusiaan dan Genosida di Indonesia sebagai krisis kemanusiaan terbesar di milenium ini.
